About these terms
These terms govern the use of notify-me, the messaging platform operated by Codeinsyt (“we”), 19 Bluebell Street, Accra, Ghana, and of this website. notify-me is a service for businesses: by creating an account or using the API, you (“the customer”) accept these terms on behalf of your business.
The service
notify-me lets businesses send SMS, email and WhatsApp messages to their own contacts through an API and an admin console.
Your account and API keys
You are responsible for keeping your API keys and console credentials secret, and for all activity under your account. If you suspect that a key has been exposed, tell us at once at info@codeinsyt.com.
Acceptable use
You may message only people who have agreed to hear from you, and you must honour every opt-out promptly.
You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and the Meta terms that apply to your WhatsApp Business Account, and with the laws that apply to you, including Ghana's telecommunications rules and the requirements of the National Communications Authority (NCA), and Ghana's Data Protection Act, 2012 (Act 843).
You must not use notify-me for spam, fraud, phishing, harassment or any illegal content.
Sender IDs and templates
Sender IDs and WhatsApp message templates may be used only once they have been approved or allowed by the relevant network operator, provider or Meta. We may refuse or withdraw a sender ID or template that does not meet these rules.
Prices and payment
notify-me is prepaid. Prices are those in your rate card. We charge per message, or per segment where a message is split into several parts, and deduct the charges from your prepaid balance.
Where applicable, WhatsApp conversation charges are billed by Meta directly to your WhatsApp Business Account and are not part of our charges.
Refunds
When your account is closed, we refund any unused prepaid balance on written request, minus payment processing fees.
Availability and delivery
We provide notify-me on a best-effort basis and do not guarantee any level of availability unless we have agreed one with you in writing.
Delivery depends on mobile network operators, email providers and Meta, which we do not control. We therefore cannot guarantee that a message will be delivered, or delivered on time.
Suspension
We may suspend your account, or any part of the service, if you breach these terms or if your use puts the service, our providers or recipients at risk. Where we can, we will tell you in advance and explain why.
Limitation of liability
Our total liability arising out of or in connection with the service is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss, such as loss of profit, revenue, data or goodwill.
Nothing in these terms limits any liability that cannot be limited by law.
Your content and recipients
You are responsible for the messages you send and for your relationship with your recipients. You will indemnify Codeinsyt against any claims, fines, losses and costs arising from your content, your recipients or your breach of these terms.
Data protection
When we process your recipients' personal data, we act as your processor and follow your instructions. Our privacy policy, linked at the foot of every page, explains what we process, who receives it and how long we keep it.
Changes to these terms
We may change these terms. We will email you at least 30 days before a change takes effect. If you continue to use notify-me after that date, the new terms apply.
Termination
You can stop using notify-me and ask us to close your account at any time by emailing info@codeinsyt.com. We may end these terms by giving you 30 days' notice by email, or at once if you seriously breach them. Any unused balance is refunded as set out above.
Governing law
These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have exclusive jurisdiction over any dispute arising from them.
